What is the TN visa?

The nonimmigrant TN visa allows citizens of Canada and Mexico to come to the U.S. to work in as a NAFTA professional in designated categories. There are dozens of professions that fall under the designated TN category. Contact an immigration attorney or VISANOW immigration consultant to determine whether or not your employee would fall into any of the TN categories.
Canadian citizens can apply for a TN visa directly at the border/port of entry. VISANOW can prepare the TN application for the individual to present to the Customs and Border Protection (CBP) officer.

What is deferred action?

According to the department of US Citizenship and Immigration Services (USCIS), “deferred action is a discretionary determination to defer removal action of an individual as an act of prosecutorial discretion.” This grant does not confer lawful status; neither does it excuse any previous or subsequent periods of unlawful presence. Existing regulations allow these individuals to obtain a work permit, as long as he or she demonstrates “an economic necessity for employment.” Deferred action grants exist under the discretion of the Department of Homeland Security (DHS).

What if my fiancé and I have not met in person within the last two years?

If you have not met in person in the last two years, you don’t immediately qualify for a K-1 visa. If you are a U.S. citizen, you can travel abroad to visit your fiancé (depending on the country your fiancé is living in, you may need a tourist visa to visit there). Alternatively, if you are the foreign national fiancé, you can apply for a B-2 visitor visa to visit your spouse here in the U.S.
